The Ombudsman agrees with IU and asks the Consortium to provide victims of earthquakes with access to their file (15/12/2017)

Gloria Martin also denounces the sending of a new shipment of letters in which the Autonomous Community requires those affected the full refund of the aid, although it recognizes that there are technical reports that show the completion of the works and that proofs are presented valid for expenditure exceeding the subsidies granted

The councilor of Izquierda Unida-Verdes, Gloria Martín, has expressed her satisfaction because the Ombudsman has given the reason for her political training regarding the refusal of the Insurance Compensation Consortium to provide the victims of the 2011 earthquakes, the information on the compensation received from this body.

Martín explained that the Ombudsman has admitted the complaint he made on November 10 and that he has sent a communication to the Insurance Compensation Consortium (CCS) in which he reminds him, as the mayor maintained, that it is "an entity of public law, integrated in the public sector and, consequently, included in the subjective scope of application of the Law of Common Administrative Procedure of Public Administrations".

This statement leaves in evidence the excuse used by the CCS to reject the requests of those affected to access the information of the compensations that were granted to them.

And is that the Consortium based its dismissal that is not subject to the advertising regime provided in that rule.

For the Ombudsman it is "difficult to understand" that the CCS denies the preceptors of the indemnities access to their files and obtaining a copy of the documents contained in the procedures that affect them.

In this regard, he reminds CSS that it is subject to the "constitutional mandate" to objectively serve general interests and that it is obliged, at least, to facilitate the exercise of their rights to those affected.

For all these reasons, the Ombudsman has initiated an investigation which will be reported to Martín, as the representative of the victims.

The mayor has shown his satisfaction because the High Commissioner of the Cortes Generales, responsible for defending the fundamental rights and public freedoms of citizens by monitoring the activity of public administrations, grant the reason to the affected neighbors and has shown convinced that it is "one more step" towards the final resolution of the conflict by the return of aid from the earthquakes of 2011, affecting about 800 families in Lorca.

The mayor of IU-Greens again denounced the lack of sensitivity and commitment of the municipal government team of the PP which said that "instead of defending the rights of their neighbors and voters, is allied with the interests of the regional government of his party, moved solely by a fundraising zeal ".

In this regard, Martin recalled that last April, the Council of Ministers had to extend until December 31, 2019 the loan of 115 million euros signed by the CARM with the Official Credit Institute (ICO) in May 2012 , to expedite the payment of aid to those affected by earthquakes.

The pazo of said loan expired on May 3, 2017. Interestingly, a few days later the beneficiaries of the aid began to receive the letters to be returned.

"For six years, the PP has not been concerned to carry out the procedure of justification of subsidies and now, with the right to reinstatement already prescribed, are dedicated to driving the neighbors crazy," said Martin.

The councilor of IU-Greens presented several examples of letters sent to the victims in which valid invoices and receipts of payment are rejected, forcing them to return the full aid.

"The letters acknowledge that there are technical reports that show the completion of the works, that those affected have valid proofs of expenditure of a value higher than the subsidies granted, and yet, they have to return everything."

Martín demanded, for the umpteenth time, the mayor of Lorca, Fulgencio Gil, to demand the materialization of the agreements adopted by the municipal Plenary to give a "political solution" to this issue and that those affected "can recover the tranquility and normalcy in their lives".

"We have been asking for it for more than six months and he has not moved a esparto," lamented the mayor of IU-Verdes.
