The City Council must demand from the regional government the development of the Couples Act Act (22/11/2018)

IU-V moves this initiative to its regional organization so that municipalities throughout the Region demand the development and implementation of this Law

Pedro Sosa Martínez, Spokesman of the Municipal Group of IU-Green in the municipality of Lorca, has registered in the ordinary plenary of November 2018, to be held this Monday, an initiative for the local government lorquina require the regional government the implementation of the provisions of Law 7/2018, of July 3, of Couples of Fact of the Autonomous Community of the Region of Murcia.

After the approval, this past summer, of this Law in which the Autonomous Community gathers for itself the competence in matter of de facto couples, the town councils of the Region, that up to date had been doing work of registration of these couples, They have seen a legal limbo and, as far as we know, they are acting in different ways: some continue to register de facto couples, although this could generate a great legal uncertainty that can have very negative consequences for registered couples and that they continue to register, since this lack of competition could imply the nullity of full rights of the inscriptions with what this implies in terms of non-recognition of rights to those registered.

Other city councils are pointing out the couples that come to their dependencies that, in view of the existing legal limbo, it is best that they wait for the development of the Law. It should be remembered that these records attest to the existence of a relationship of conjugal similar affect with the legal derivations that this has in terms of recognition of rights.

After the approval of the aforementioned rule by the Murcian parliament, the regional government should have proceeded to its development by means of the Regulation contemplated in its transitory provisions and the constitution of the Registry of Pairs of the CARM, with the integration of office and automatic of the inscriptions of de facto couples of the municipal registers in the Autonomous Register.

IU-V demands that the Murcian government proceed to the immediate development of the Law and points out that this delay may be due to various causes, and none of them worthy of any praise.

The first is that, regardless of any political or ideological consideration, we are facing a regional government that is absolutely inefficient in fulfilling its functions.

The second, this more ideological, is that the Register of Couples in Fact gives certainty and legal certainty to a more plural and inclusive model of personal relationships that moves away from the traditional model that is the only one that the Murcian right seems to bet on. .

And the third has to do with the insubordination of the executive to implement the rules that come from the Murcian legislature in which it has no majority.

Sosa has pointed to this last issue that very recently the Constitutional Court has disavowed the regional government of the PP for the non-application of the Regional Housing Law.

In this sense Sosa appeals to the group of Citizens (C's) whenever they are supporting a government in the Region of Murcia that is unsupported by the implementation of the laws that are passed in Parliament.

In order that this initiative has more guarantees to move forward, the Spokesman of IU-V has communicated its intention to transfer it to its regional organization so that the IU councilors in the various municipalities present it in the plenary sessions and force the regional government to development and effective implementation of the Law.
