IU: "If things had been done well, the winner of the Palace of Justice would be paying 1,600 euros a day for the delay in the works" (08/01/2019)

The councilor of this formation, Gloria Martin, denounces that the Galician merchant 'Constructora San José, S.A', has exhausted eight of the 24 months available for the execution of the work and regrets that the pressing needs of the municipality in judicial matters depend on the interest of a company that wants to wipe out the historical heritage of Lorca to lower costs and expand their profit margin

The councilor of Izquierda Unida in the City of Lorca, Gloria Martin, has demanded the fulfillment of the agreement of Plenary last November by which, unanimously, the Municipal Corporation urged the Ministry of Justice to the "immediate" start of the works of the Palace of Justice of Lorca.

Martin has claimed that the company based in Pontevedra 'Constructora San José, S.A'., "Comply with the contract signed with the Undersecretary of the Ministry of Justice and start work, in this sense, Martin has warned that the company awarded it has already exhausted eight of the 24 months it has available for its execution, which have a bidding budget of 8 million euros and are necessary to put an end to the dispersion of judicial offices in the municipality. "The current facilities are insufficient, obsolete and, in some cases, are inaccessible for people with reduced mobility, "said Martin, who said that the needs of Lorca in judicial matters can not depend on the interest of a particular company.

Martín has shown the rejection of his political training to the demolition of the facade of the nineteenth century Selgas street -included in the plot that will house the future palace of Justice- which has a degree of protection 3 in the current Special Protection Plan and Integral Rehabilitation in sector II of the historical artistic group of Lorca (PEPRI).

This requires its conservation, something that is also contemplated in the specifications of the project.

The mayor of IU recalled that, in 2016 alone, the City Council invested 118,500 euros to guarantee the stability of the façade and preserve the elements that have cultural protection, so the adjudicator can not claim to "throw that investment overboard and to destroy part of Lorca's historic heritage just to lower costs and expand their profit margin, "Martín said.

"The winning company had to know perfectly the details of the project when it decided to participate in the bidding process, if it was not able to move to Lorca to be interested in the state of the plot and now the accounts do not come out is their problem, but can not continue to hinder the construction of the Palace of Justice, "said Martin.

"We do not know how many Lorca construction companies work in Galicia, but we are tired of the great works of our municipality being carried out by foreign companies, which do not create jobs in Lorca and which are even charged in corruption cases, so they should be invalidated to attend public competitions, "Martin said.

The mayor also lamented that, despite being a work of large budget and size, the Ministry of Justice did not include in the contract partial execution periods, so now can not apply penalties for serious or very serious breach of obligations of the contractor.

"Under the Law on Public Sector Contracts, the Administration could be imposing up to 1,600 euros a day penalty for breach of a partial execution period," said Martin.

However, by not contemplating it in the list of administrative clauses, the winning company "is leaving rositas".

A merchant recalled - imputed along with seven other constructors by a court of Murcia for the alleged embezzlement of up to 60 million euros in the construction of several sections of the AVE to the Region.

In this regard, Martin described as "irresponsible" that a public contract of eight million euros does not provide the necessary guarantees to ensure the proper execution of the work and that it is required of small businesses that opt ​​for any bidding process.

New question to the Government

On the other hand, Martin has reported that the national deputy United Left, Ricardo Sixto, has returned to ask in writing to the Government of Spain on the delay of some works "that Lorca have been waiting for more than 30 years."

Sixto asks to know "the technical problems or deficiencies in the project that justify its stoppage, the date of resumption of work as well as the start of operation of the new building."

The question was registered in the Congress Table on November 29 and has not yet been answered, something for which the Government has until February 13, according to the Rules of the Cortes Generales.
