The Tax Agency announces the seizure of the property of a person affected by the return of the aid from the Earthquakes (26/04/2019)

The councilor of Izquierda Unida-Verdes, Gloria Martín, warns of a notice of seizure on the private vehicle of a victim of the earthquakes of 2011. This is a particularly sensitive case for which demands, again, a fair and reasonable solution because "It is insane that the aid that was granted to repair the houses affected by a devastating earthquake could become the cause for the victims to end up losing their assets, including their homes"

The councilor of Izquierda Unida-Verdes, Gloria Martin, has warned that the Tax Agency of the Region of Murcia has issued a notice of seizure on the private vehicle of one affected by the return of aid from earthquakes.

This is a case for which Martin has asked in many instances for a solution because it is a "very delicate" situation on which the Administrations have responded with a special "coldness" and "insensitivity".

This neighbor could not afford the repair of his home within 12 months because he was incapacitated by a severe depression that came after the death of his sister, whose eight-year-old daughter had to take over after becoming an orphan.

However, the affected did not use the money from the grant.

When he was able to carry out the works, he informed the office of the earthquake in Lorca, to which no objection was raised, with the intention of being able to fully recover his home and justify "every last cent".

However, despite that request, his payroll was finally seized and now, in addition, the Tax Agency threatens to act also on his private vehicle, in addition to blocking another bank account.

"If they do it with movable property, nothing will prevent them from starting to also seize real estate and that those affected may eventually lose their homes," said Martín.

Therefore, the mayor of IU-Greens has demanded that the regional government give "immediate instructions" for the Tax Agency to grant facilities to those affected by the reimbursement of subsidies.

"It's insane that the aid that was granted to repair the houses affected by a devastating earthquake could become the cause for the victims to end up even losing them," said Martín.

To the thread, it assured that "ten people could be wrong, when we speak of 3,500 it is because who has not done the things well they are the Administrations".

Martín also explained that Fomento has transferred these files to the Treasury without having resolved on liquidations contested by administrative means through a discretionary appeal for reinstatement, and in respect of which the precautionary suspension of the execution had been requested due to the existence of impossible or difficult damages. repair for those affected.

"They do not answer the neighbors and they pass the ball to the Tax Agency", said Martín, who warned that this violates articles 9, 24.1 and 106.1 of the Spanish Constitution and contravenes legal security, the right to effective judicial protection and the prohibition of defenselessness, as well as the submission of administrative activity to the control of legality.

As if that were not enough, the Treasury also charges people theoretically "unattachable", because they subsist on less than the minimum interprofessional salary.

In this regard, he recalled that article 27.2 of Royal Legislative Decree 2/2015, of October 23, approving the revised text of the Workers' Statute Law, establishes that: "The minimum interprofessional salary, in its amount, is unattachable. "

In the same sense, article 607.1 of Law 1/2000, of January 7, of Civil Procedure is stated, which establishes that: "Salary, salary, pension, remuneration or its equivalent, which does not exceed the amount indicated, is unattachable. for the minimum interprofessional salary ".

However, Martín explained that "they are destroying everything", and proceeding to the seizure of bank accounts even of those who had requested the payment split.

The mayor recalled that a part of those affected will go to trial, for what the platform of those affected has appointed as their lawyer to the lawyer Joaquín Dólera.

"We have the verbal commitment of the Mayor that the City Council will cover the cost of legal representation, but we want it in writing, his and all those who come to the Mayor of Lorca," he concluded.
