The councilor of Izquierda Unida-Verdes in Lorca, Gloria Martin, has filed a complaint with the Prosecutor of the Region of Murcia for a possible crime of malfeasance against the secretary of the Ministry of Development and Infrastructure of the Region of Murcia, Yolanda Muñoz.

Martín explained that there are indications that Muñoz is issuing orders "unfair and contrary to the law" in the case of the return of aid for those affected by the 2011 earthquakes in Lorca.

Specifically, the mayor of IU-Greens has referred to the orders of the Ministry of Development for which it dismisses appeals for reconsideration raised by those affected, in which they apply to qualify for the statute of the CARM to demand the reinstatement of the AIDS.

Muñoz is aware of the reports of the legal services of the City of Lorca, the Autonomous Community itself although this has never been provided to those affected and the State Bar that they dictate, as set out in Article 10.3 of Decree 68/2011 , that the computation of four years for the prescription begins "when the term of justification of the works" that had the beneficiaries of the aids ends.

That is to say, from the moment of the completion of the works, the affected ones had a period of justification of six months, and from that moment they would begin to count the four years of the prescription.

However, Muñoz does not take into account this date, but computes the full 12 months that the beneficiary of the aid had to face the works, whether they were exhausted or not.

The criterion advocated by the affected platform and by the Administrations is being applied in the orders issued by other positions of the Ministry of Development but not by Muñoz, "who insists on applying a general formula that does not take into account when the works or when the deadline to justify the use of aid expired, which is to the detriment of the legislation and the interests of those affected, "said Martin.

"Munoz can not apply a different criterion to his own department to determine the limitation periods," explained the councilor of IU-Greens, "and even less when they are contrary to the law and legal reports of three public administrations, which they are also known to her, as she has publicly admitted, "he recalled.

Martín has indicated that his decision to file the complaint in the Prosecutor's Office is due to Muñoz's commitment to "not come to his senses" and insist on the "abuse of his authority" despite the multiple warnings that have been made from the platform of those affected and from his political formation.

"She knows that dismissing these resources with arguments contrary to the rules, those affected have no choice but to go to court when they do not even have money to pay a lawyer because the reimbursement of these grants and their interest and surcharges has of course the family economic ruin for the victims ", concluded Gloria Martín.
