The Department of Consumption recovers 173,240 euros for Lorca who submitted claims at OMIC during 2019 (27/02/2020)

The Councilor of Consumption of the City of Lorca, José Ángel Ponce, has taken stock, this morning, of the actions carried out in the Municipal Office of Consumer Information (OMIC) together with the head of this service, Ana Ruiz Meca and the Consumer inspector, Simón Madrid.

The mayor of Consumption stressed that “thanks to the efforts made by the technicians of OMIC, during the year 2019, economic benefits of 173,240.84 euros were obtained for consumers due to claims filed for returns, cancellations, changes equipment or cancellations, 30,240 euros more than the previous year of 2018 when the reimbursed amount reached 143,000 euros ”.

José Ángel Ponce has detailed that “during the past year the consultations made before the Municipal Office of Consumer Information were 7,724 and of the total claims made, 1,326 files were generated”

The councilor explained that “in groups, the claims made in food (supermarkets, small businesses) were three and 31 consultations;

in products and goods (furniture, computers, appliances, telephones, vehicles, textiles, footwear, housing, toys, bookstore) 174 complaints and 1,086 inquiries;

With regard to services (teaching academies, insurance, loans, financial services, basic supplies, transportation, hospitality), 1,149 claims and 6,607 consultations.

Among the products and goods, 81 claims corresponded to Apparatus (acquisition of mobiles and similar, sale of electronic devices, sale of household appliances, sale of new, used vehicles) and 371 inquiries.

Regarding special sales (at home by telephone, TV and Internet) 54 complaints and 214 inquiries were registered.

In services, within the insurance subgroup 95 claims and 379 inquiries were registered, in financial services (Commissions, direct debits, personal and mortgage loans, passbooks, impositions) 87 and 493 inquiries were received;

and in terms of basic supplies, of the total of 715 claims 58 were for electricity, 25 for internet, one for gas stations, 228 for mobile telephony and 36 fixed telephony, 325 for telephony packages, 31 for gas and 11 for water.

And of all the queries processed, 2,101 to 217 correspond to electricity, 147 internet, eight with gas stations, 563 mobile telephony and 168 fixed, 752 telephony package, 151 gas and 95 water.

In reference to the trend of the last year, the mayor of Consumption emphasizes that “the matters discussed, both in the consultations and in the claims, do not differ much from that of previous years, the most prominent issues being those related to special sales ( at home by phone, TV and Internet) due to problems related to withdrawal periods, returns, invoices and contracts;

the acquisition of devices due to guarantees, purchases (permanent establishment / permanent establishment), invoices and contracts;

basic supplies with problems related to changes in the marketing and registration without consent, irregularities high / low, withdrawal periods, additional maintenance services, controversial billing and problems related to changes with digital counters;

and financial and insurance services motivated by bank account cancellations, mortgage loan formalization expenses, bank account maintenance fees, bank charge refunds, bank service fees, cashier and microcredit procedures, in addition to other problems registered in the insurance sector as cancellations of policy, modification of the conditions, breach of the particular and general conditions and coverage ”.

José Ángel Ponce has stressed that "most of the claims presented in our office, are resolved favorably for the consumer, without having to go to court or extrajudicial."

It should be remembered that the Municipal Office of Consumer Information -OMIC- belonging to the Department of Health and Consumption of the City of Lorca is responsible for information and attention to the consumer and user, as well as to transfer consumer claims to the companies for their knowledge and sending, where appropriate, to the corresponding agencies.

Likewise, the OMIC, serves as a support for the Consumption Arbitration Board of the Autonomous Community of the Region of Murcia;

and from there, arbitration hearings are held throughout the year, for citizens of our municipality such as the neighboring ones, Totana and Puerto Lumbreras.

The Hearings held throughout the year 2019, have resulted in a total of 80 hearings, of which 61 are claims from this municipality, the rest of nearby municipalities.

On the other hand, José Ángel Ponce has added that “during the past year a total of 82 inspection actions have been carried out that ended with the lifting of the corresponding minutes, to which we would have to add the inspection appearances that did not motivate the minutes, as they aimed to provide information to retail trade, as well as transfer the regulatory regulations in the field of consumption to both commercial establishments and consumers and end users.

Carrying out a total of 27 inspections ex officio, to verify compliance by the commercial and commercial establishments of the consumer and user protective regulations ”.

Ponce has specified that from the total inspections nine minutes were drawn up for non-compliance with the possession of claims sheets and poster announcing them, five for breach of the regulations on guarantees of consumer goods (toys, mobile terminals, electronic products) , six minutes for the non-exposure of prices of the products offered in the shop windows and for breach of the regulations for the promotion of sales sales and liquidation, five minutes for breach of the regulation in sales promotions for balances and liquidation and, finally , two other acts for the inclusion in the contracts of sale or tickets of general contracting conditions that presumably could constitute abusive clauses ”.

The Councilor for Consumption has explained that “also at the request of OMIC, various inspections have been carried out based on the claims filed by users in front of various establishments and in which the reality and certainty of the claimants' arguments have been verified.

Of these inspections, seven acts of a sanctioning nature have been drawn up ”.

In addition, during this year 2020, the consumer inspection took place some Thursday at the Santa Quiteria Weekly Market where inspections have focused on those positions that sell used clothing to require the exhibition of an advertising poster that reports on the nature of second hand of the clothes sold (poster delivered by the inspection itself).

And six minutes have been processed for the non-exposure of said poster ”.

Finally, inspection actions have also been carried out to check the notifications of alert networks due to the disagreement of certain products offered for sale for their withdrawal from commercialization in the internal market, since they violate the right to safety and health of consumers and users, and that during the past year they reached the figure of 42, of which 13 have concluded with the return of the units of the product alerted to the distributor or manufacturer, along with others that have been directly destroyed in the presence of this inspection.

As for the products that have been subject to these inspections, and that have been returned or destroyed, we found two units of a costume that consisted of eyebrows and a mustache due to the risk of burns;

13 pacifier chains intervened on which he was alerted by the risk of suffocation;

10 bags of hot water that could cause scalding;

five units of belt and tensioner for car due to the risk of various injuries such as bruises, dislocations, fractures and shock;

18 units of ratchet tie down that could cause traffic accidents;

a portable work light for the risk of burns;

three cable reels with the risk of electric shock;

five baby carrier backpacks for the possibility of causing injuries;

two cotton candy machines by electric shock;

seven popcorn machines for the risk of burns;

nine universal adapter units by electric shock;

a unit of Building Blocks because it could cause suffocation and finally, 29 units of LED anti-mosquito lamps due to the risk of electric shock ”.

Finally, the mayor has thanked the work of the technicians of the Municipal Office of Information and Consumer Services and recalled that it is a free service that can be used by all Lorca who want and require it.
