IU demands rigor and seriousness in the imposition and collection of fines related to the pandemic in Lorca (20/10/2020)

| Sosa brings to the Plenary several proposals on this matter that are already applied in other municipalities | The Municipal Spokesman of IU-Verdes, Pedro Sosa, explained this morning the battery of proposals regarding sanctions and citizen security related to the control of COVID-19 in Lorca, which he will defend on behalf of his political group in the ordinary Municipal Plenary October to celebrate next week. Already last September the mayor of IU-V was interested in the sanctions that have been processed as a result of the complaints made by the Local Police of Lorca.

Sosa then asked about the number and processing status of both the complaints related to the misuse of the mask, as well as those related to parties and bottles, violating the health regulations of the Region and municipal ordinances.

This request for information was "answered" in the September plenary session by the Police Councilor.

The following answer literally appears in the minutes of that plenary session: "2170 complaints have been made.

At parties, 165 plus those this weekend.

2170 have been sent, and I know that 2 have been sent to the offenders.

245 more those of the weekend. Then I can break it down to you and I have no problem sending it to you.

" Pedro Sosa maintains that since this response does not satisfy, at all, the information request made by his group and also departs from the philosophy of those first intentions publicly stated by the Mayor of Lorca at the beginning of the pandemic in our municipality, in those that the first mayor openly maintained that "the money from the fines will be to buy masks", we are now forced so much to clarify in plenary session if the product of the 175 fines that the Local Police had placed on Lorca for breaching the Confinement has had the final destination expressed, as to propose some measures that result in the rigor and due seriousness that must be put in sanctioning those who do not comply. The main objective of the motion, Sosa maintains, is to make effective in Lorca one of the main theoretical functions of sanctioning law, of sanction as a legal instrument, which is none other than that of general prevention, to dissuade those administered, with the Threat of an economic sanction or of another compulsory provision in the face of infringing conduct. We cannot tolerate, continues the IU councilor, that the effort made by the agents of the Local Police of Lorca with those more than two thousand complaints made is frustrated by an ineffective processing of the disciplinary proceedings.

And that message is valid both for the regional administration (as regards its competences) and for the local one with respect to those files in which the municipal ordinances reside their competence in the same, as is the case of the consumption of beverages on the road.

public sanctioned by the local ordinance of civic coexistence. We have to avoid that the effort of the local agents of Lorca comes to nothing and that the deterrent function of the sanctions is also buried by the inoperability of the sanctioning administration, or by a possible prescription of the files, for that reason we propose, on the basis From the experiences already implemented in other municipalities to combat the spread of the disease in their territories, the approval of the agreements, the following: Regardless of the destination -finalist or not- that may be given to the product of the sanctions processed by our local administration related to the pandemic, this Plenary urges the local government to, through its technical services, value it at the appropriate time and convenience.

that the protection equipment against COVID-19 be acquired by the City Council through the well-known Central Contracting of the FEMP. The Lorca City Council, emulating other Spanish local administrations, will form a "Specific Intervention Group" in its Local Police staff related to the health crisis and the prosecution of infractions linked to it. The City Council of Lorca urges the local government, through its technical services, to value the opportunity and convenience of modifying the Municipal Ordinance for the Protection of Citizen Coexistence and Prevention of Antisocial Actions so that group consumption of alcohol on the road In addition to being punished by the economic sanctions provided for in the aforementioned ordinance, it can be stopped, where appropriate, by substituting those fines for the provision of services for the benefit of the community such as cleaning parks, waterways and recreational areas.

object of parties and bottles. The City Council of Lorca will formally contact the Ministry of Health to request timely and detailed information on the status of processing of all the disciplinary proceedings initiated by the same after the complaints sent for that purpose by the Local Police of Lorca, giving complete information to this Plenary on the eventual response (or lack thereof) of that autonomous body.
