[IU Lorca regrets that PSOE and C's reject the allegations to the IBI presented by self-employed workers (28/12/2020)

Pedro Sosa and Gloria Mart n warn that the ordinance that the municipal government team intends to approve is contrary to the law and does not comply with the jurisprudence of the Supreme Court, as recognized in a report from the economic services of the consistory.

They criticize that Diego José Mateos puts the interest of the rentiers ahead of the help that the economic sectors most affected by COVID-19 need so that they can maintain their activity and employment The councilors of Izquierda Unida-Verdes in the City Council of Lorca, Pedro Sosa and Gloria Mart n, have warned that the fiscal ordinance of the IBI that the municipal government team intends to approve this morning in plenary session is "contrary to law" and does not comply the jurisprudence of the Supreme Court, as recognized by the report of the economic services of the consistory on which the PSOE and C's have relied to reject the allegations raised by a group of self-employed workers. Sosa recalled that during the period of public exposure of the tax ordinances for 2021, IU-Verdes encouraged those affected to file claims so that the 95% IBI bonus has a favorable impact on the activity they carry out merchants in those cases in which the taxpayer of this tax (the owner of the premises) does not coincide with the person who carries out the activity (the lessee). However, the municipal government team of Diego Jos Mateos has rejected these allegations and claims that this optional bonus in the IBI, which can only be applied in favor of properties in which economic activities are developed that are declared of special interest or municipal utility by the Plenary, is granted by submitting a simple census declaration.

This means that the City Council "will not require any guarantee that the IBI bonus will affect the self-employed and will serve to maintain that activity and employment, which is what is truly important", Sosa said. The technical report on which the municipal government team is based openly recognizes that the Lorca town hall has departed from the "criteria" of the Supreme Court ..

Something that the IU councilors have called "scandalous".

"The high court does not establish criteria or recommendations, but rather establishes Jurisprudence, in cassational interest, through the doctrine that emanates from its Sentences," explained Gloria Mart n, who recalled that "we are talking about one of the sources of Law of our legal system from which one cannot decide on their own whether to depart or not ”. The mayor of IU-Verdes regretted that "due to laziness, stubbornness or misunderstood pride," the municipal government of Lorca shows less sensitivity to the autonomous workers more affected by the COVID-19 crisis than conservative municipalities such as the Madrid or Zaragoza, or others from the PSOE, such as Getafe.

“There they have understood the need to link the bonus that tenants and landlords have reached an agreement so that this savings in the IBI is reflected in measures that help those who carry out the activity to overcome the crisis caused by the COVID-19, such as rent reductions, said Mart n.

"The important thing is not to apply a grace measure to the owners of the premises, but to help the economic sectors that are going through the worst so that they can maintain their activity and the employment they generate," he said. The councilors of IU-Verdes stated that Mateos' policy is even contrary to the measures that the Government of the nation is adopting, of the same political sign, which on December 22 approved a Royal Decree-Law that imposes the reduction of leases of the premises occupied by SMEs or freelancers in the most punished economic sectors.

"The peculiar socialism that Mr.

Mateos uses leads him to protect the interest of the rentiers at the expense of those who are really suffering from this crisis, which are the workers," Sosa and Martin censured. "Mateos can not make the world a montera contravening the Local Tax Law, the Supreme Court Sentences and wasting the path that other major cities have opened where they have been concerned that the IBI reduction benefits the self-employed" , said the councilors of IU-Verdes. For this reason, Sosa and Mart n have announced that “they will fight to the end” so that in today's plenary session “sanity prevails” and “the sensitivity and support that we owe to the autonomous workers affected by this crisis ”, For the Government team to accept the amendment presented and incorporate it into the tax ordinances of 2021. Regarding the technical report that the municipal government team uses as an “alibi”, Sosa and Mart n reminded Mateos that, on other occasions, “that has not been an excuse to adopt the fairest political decisions” .

It happened for example in the tax ordinances of 2020, when the municipal intervention recalled the obligation to increase public prices.

Those prices were ultimately frozen thanks to pressure from IU, which conditioned its support for the ordinances, among others, on that issue.

“If last year they did not take these reports into account to adopt a political decision, now they can do the same for the benefit of the self-employed,” concluded Sosa and Mart n.
