The Consistory asks the Government of Spain to maintain the current VAT system for cases of office duty (27/02/2017)

It is a proposal that would directly benefit the collective of legal professionals of our city, which enhances an extraordinary work always ensuring to offer a public service of maximum guarantees in the field of justice.

The Councilor for Economy in the City of Lorca, Fulgencio Gil, has informed that the Municipal Council will request the Government of Spain to maintain the current system of Value Added Tax (VAT) for the actions of professionals appointed ex officio for Defense of the beneficiaries of the right to free legal aid.

Fulgencio Gil has stated that this is a proposal that would directly benefit the collective of legal professionals of our city, which enhances an extraordinary work always ensuring to offer a public service of maximum guarantees in the field of justice.

The free legal system offered to citizens who need it and meet the requirements, guarantees equal protection before the Justice to all Spaniards.

The Edil has indicated that Law 1/1996 of Free Justice indicates the obligation of the Bar Associations to regulate and organize the service which implies that for lawyers, even though it is a voluntary act, it is a burden on the collective to guarantee the sufficiency of Service and therefore the effective judicial protection of those who lack the resources to litigate.

Fulgencio Gil pointed out that the General Council of Lawyers, which includes more than 44,000 lawyers from the service of the office, has shown his displeasure at the report of the General Directorate of Taxes that includes the consultation V0179-17 Of the Court of Justice of the European Court and that services provided by lawyers in the framework of free legal aid should not be exempt from VAT.

The Senator Lorca has also stated that the normative project in which progress is being made to finalize the Organic Law of the Right to Defense will improve mechanisms for the protection of citizens' rights before the Justice, and the reform of the Law of Criminal prosecution that will grant the prosecutor the direction of the investigation phase.
