The Municipal Plenum unanimously approved a motion rejecting the creation of the Uniprovincial Courts on land clauses and claim of mortgage expenses in Murcia (29/05/2017)

This motion is given by a brief presented in the General Registry of the City of Lorca by the deans of the Bar Associations and Attorneys of Lorca.

In the same request they reinforce the Courts of each Judicial Party instead of creating one in the capital to avoid to the citizens displacements and unnecessary expenses

The Mayor of Lorca, Fulgencio Gil, has reported that the Plenary of the City of Lorca as a whole has approved this morning a joint motion of all municipal groups rejecting the creation of Uniprovincial courts on land clauses and claiming of mortgage costs in the city Of Murcia.

Fulgencio Gil explained that "the Plenary has agreed to request before the General Council of the Judiciary (CGPJ) the modification of agreement to create uniprovincial courts on land clauses and claim for mortgage expenses in the city of Murcia, reinforcing, instead, the Judges of each judicial party, so that citizens can present their claims in court and avoid unnecessary travel and expenses. "

The Mayor of Lorca has indicated that "this motion is given by a brief filed in the General Registry of the City of Lorca by the deans of the Illustrious Bar Associations and Attorneys of Lorca. In the same was expressed that the deans of Murcia, Lorca and Cartagena were summoned to a meeting with the President of the High Court of Justice of the Region of Murcia in which they were informed that, by an agreement of the CGPJ, the Ministry of Justice had issued a favorable report for the creation of a Uniprovincial Court, With headquarters in Murcia, which would then be created by Bis Courts but would always have their headquarters in Murcia capital. This court would have jurisdiction for all procedures required to claim the annulment of land clauses and the amounts collected by it, as well as The claim of expenses incurred for the constitution of the mortgage ".

Gil pointed out that "this Judicial Party, which is formed by the municipalities of Lorca, Aguilas and Puerto Lumbreras, considers that this measure will affect the rights of citizens of these localities and will seriously hamper their possibilities of interposing The actions that in law correspond to them against the banking entities. It would be a way of distancing justice to the citizen and with that to block the possible claims of the same, which will surely entail the fact that many citizens decide not to claim the banks, Which will be the great beneficiaries ".

The First Edil, in this sense, has stated that "from the City of Lorca we watch over the interests of our citizens and we join the complaint of the Lorca Bar Associations and Attorneys, as we are firmly convinced that this measure Would give rise to inequalities that would cause a great cost for the population of Lorca, as well as for Aguilas and Puerto Lumbreras, since to have to move until Murcia, would be the citizens the truly harmed because it would be difficult the Constitutional Right to the effective Judicial Protection In addition, it should be noted that only in Lorca, where it is estimated that there are close to 3,000 mortgages that could be subject to a claim, calculating travel costs and lost hours of work, would mean for Lorca an expense of about 164,000 Euros, which they would not have to pay if the courts were in our city.
