The Councilor of the United Left-Greens, Gloria Martín, today called for the cease, in a fulminating manner, of the Secretary General of the Ministry of Presidency and Promotion, Yolanda Muñoz, for showing spread "false information", contribute to the confusion of citizens and for showing a "very serious ignorance" of Law 7/2005, of November 18, on Subsidies of the Autonomous Community of the Region of Murcia that should be applied to those affected by the return of the aid for the earthquakes of 2011 in Lorca,

Speaking to a regional media outlet, Muñoz said yesterday regarding the statute of limitations, that, "in fact, the term of six years is not since the earthquakes occurred but from the payment of the aid."

In this regard, Martín recalled that according to Article 33.1 of the aforementioned Law on Subsidies, "will prescribe at four years the right of the Administration to recognize or liquidate the refund".

A deadline that does not begin to count as "from the payment of the aid," as Muñoz said, but from "the day after the deadline to submit the justification [of the aid] by the beneficiary" (art. 33.1 (a).

Martín harshly criticized that the autonomous administration maintains in one of its highest echelons a person who "manifests a deep and unjustifiable ignorance of the laws that govern the whole procedure of autonomic subsidies".

In her statements, the Secretary General of the Ministry of Presidency and Development comes to ensure that the City Council is also responsible for granting aid that was "autonomous and state 50%.

He also stated that the CARM is not obliged to return any aid and that the fact that the procedure is called "reimbursement", that is, of return, is "a simple denomination" and a "mere procedure."

In this regard, Martín said that many victims have received letters informing them that the Joint Commission, at a meeting on July 27, "raises the competent body to initiate reinstatement file", concerning subsidies.

"If that is not a requirement for the return of aid that God comes and see," said Martin.

A Joint Commission which, in addition, proceeds to modify the initial amount of the aid, "more than five years after the administrative act of reference, which is the granting of the subsidy".

In that sense, Martín explained that although the Administration has the power and competence to review its own acts ex officio, it has a legally recognized period to carry it out, as established by Law 39/2015 of the Common Administrative Procedure of Administrations Public

"The review of said act after the legally established period, is contrary to equity, good faith, the right of individuals or the laws," he said.

The councilor of IU-Greens, criticized Muñoz for ensuring that CARM ensures that public subsidies "do not prescribe," when the Court of Auditors has "thrown the ears" of the regional government, after detecting "significant delays since the detection of the irregularity [in the justification of the aid] until the start of the reimbursement procedure, as well as delays from the date of notification of the same until the liquidation of the reimbursement.

Finally, Martin demanded that CARM "stop deaf ears" to the requirements of the Plenum of the City of Lorca to apply a "technical and political" solution to the process of massive refunds of subsidies initiated in Murcia.

In this respect he recalled that the highest representative body of Lorca has urged the regional government in this regard on two occasions in July and September 2017 - through two plenary agreements.
