The opposition challenges new Limusa employment bases that clearly violate the principles of equality of access and transparency (01/12/2017)

The spokespersons of PSOE, IU Verdes and Ciudadanos in Lorca present an administrative appeal against the bases for the selection of 6 cleaners and 4 cleaning peons for being "manifestly illegal".

They ask for the nullity of the process for violating the principles of equality and access and free competition to public employment, and demand that both selection processes be paralyzed while the present appeal is not resolved.

The spokespersons of the municipal groups of the PSOE, IU-Greens and Citizens in the City of Lorca, Diego José Mateos, Pedro Sosa and Antonio Meca, have demanded from the Mayor of Lorca the cancellation of the bidding processes of selective processes opened by the municipal company of LIMUSA cleaning, for breaching "again and in an evident manner" the principles of equality, and access and free competition to public employment.

Therefore, they have filed an administrative appeal to declare as null the basis for the selection of 6 cleaners and 4 cleaning pawns.

They assure that these bases, published on November 14 on the website limusa.es "clearly violate the regulations applicable to personnel selection processes".

In the presented resource, according to the applicable normative scope and in particular the article 55 TREBEP, they assure that the current call violates the constitutional principle of access in conditions of equality, since in the forecast that appears, the participants are obliged to be in Unemployment for 6 months "uninterrupted at the time of publication of the call."

They claim that this is a "clearly discriminatory exclusionary criterion" and "implies a limitation of the principle of equal access to public employment completely arbitrary."

It is therefore, they say, "palmaria" that this prior condition "is illegal, arbitrary and contrary to the constitutional principles of equality, merit and ability to access public employment."

As for the publicity of the call, they denounce that this has been done exclusively on the website of the company, "disdaining other means of advertising", so that the principle, also constitutional, of advertising "has been restricted too much" in this call.

In addition, they ensure that "once again" the contracting body is "unipersonal", since it falls on the figure of the manager.

They insist that this circumstance "breaches not only the obligation that the bodies be collegiate, but also that the manager, being a position of free political appointment, fails to comply with the principle of independence of the body, since it depends on a discretionary and free appointment. dependent disposition of political power.

They assure that the bases show again "the arbitrariness and discretionality" of the management and show that the principle of transparency, merit and capacity is once again breached.

Therefore, they demand that the nullity of both bases be declared and the procedure initiated be archived.

Likewise, they demand that the processing of the selective processes be suspended until the appeal is resolved.
